Early reporting and active involvement by the institution and UE aressential for successful claims resolution. An institution that fails to meet the reporting responsibilities outlined in its insurance policy risks denial of coverage or loss of full benefits. Reporting considerations vary with the type of policy.
United Educators' comprehensive educators legal liability (ELL) policy provides coverage for the institution as well as its trustees, directors, and officers. At the institution's option, the policy also covers employees, volunteers, and in some circumstances, students and interns. To proactively keep your campus safe, the comprehensive EduRisk™ risk management program is included with each policy, featuring an extensive risk management library and personalized advisory services via telephone and email.
ELL's broad, wrongful acts coverage protects against a wide range of potential claims involving educational institutions including:
The ELL policy provides limits of up to $40 million. Employment Retirement Income Security Act (ERISA)/employee benefits coverage is offered by endorsement with limits of up to $10 million.
The ELL policy covers employees, trustees, volunteers acting on behalf of the institution, students (when acting to comply with the institution's code of conduct), and institutional review boards (for nonprofessional liability).
True worldwide coverage means that lawsuits do not have to be brought in U.S. courts. UE has defended against overseas negligence suits brought by foreign nationals. Our worldwide protection is even more critical as educators and students expand their geographic footprint.
UE's supplemental crisis response program, ProResponse, helps institutions respond to unusual circumstances requiring a rational approach to legal matters, professional public relations counsel and a thoughtful appreciation for the emotional trauma of the situation. ProResponse is available to members who carry UE's educators legal liability (ELL) and any form of general liability (GL) coverage such as CGL, GLX, GLU or BLX. Learn more.
Members who carry an ELL or a GL policy may be eligible to earn a Risk Management Premium Credit by participating in specific risk management activities. Learn more.
Many incidents result in allegations that trigger claims in both a GL and ELL policy, known as hybrid claims. Policies with separate insurance carriers often result in coverage disputes as to which policy and carrier should respond to the claim, leaving the policyholder in the middle. When UE writes both the primary GL and ELL coverage, we add our unique endorsements which provide broader, coordinated coverage. Read more about UE's Seamless Coverage.
Trends in the worlds of business and education mean that educational institutions are operating in a new legal climate. Greater scrutiny of board affairs has resulted in increased litigation and legal exposure for board members as individuals. Our ELL policy includes Directors and Trustees Liability Coverage, also known as Directors and Officers coverage, or D&O, and was created with these risks in mind. Directors and Trustees Coverage can also be written as a stand-alone policy. Learn more.
